Determining Child Custody
In the best case scenario, you and the other parent can negotiate a child custody arrangement and parenting schedule out of court. This gives you more control over the outcome, reduces the time and expense, and lessens the stress.
If you are contesting physical custody or parenting time (where the child lives), or legal custody (decision-making authority over the child), and cannot resolve it out of court, a judge or neutral selected arbitrator will determine the outcome. Our skilled New Jersey custody lawyers will advocate on your behalf. The judge will then make a custody determination that is in the best interests of the child, based on factors such as:
- The parents' ability to communicate and agree on issues regarding the child
- The relationship between the child and each parent, as well as siblings
- Any history of abuse by either parent
- The preference of the child, if the child is old enough to form an intelligent opinion
- The physical distance between the parents' homes
- The parents' work schedules
Child Support
The primary method to determine child support in New Jersey is to use the state child support guidelines, which are based primarily on incomes and amount of parenting time. Our role is to ensure that the court has the most accurate information, particularly if one party is self-employed and may not be reporting all sources of income. We also represent clients in modification hearings if financial circumstances change, and in enforcement actions if the obligor is not paying court-ordered support.
